These Terms and Conditions govern the services and products offered by our agribusiness and organic farming enterprise. By accessing our services, purchasing our products, or engaging in any form of collaboration, you agree to the following terms. Please read them carefully before proceeding.
1. General Terms
1.1. These Terms and Conditions apply to all transactions, agreements, and contracts related to the provision of agribusiness services and organic farming products.
1.2. By using our services or purchasing our products, you acknowledge that you have read, understood, and accepted these terms.
1.3. We reserve the right to modify, update, or change these Terms and Conditions at any time. Any changes will be communicated to you via our website or through direct communication.
1.4. These Terms are governed by the laws of India, and any disputes shall be subject to the jurisdiction of the courts in India.
2. Products and Services
2.1. We provide a range of agribusiness services and products including, but not limited to, organic farming consultation, organic seeds, natural fertilizers, farming equipment, and farm management services.
2.2. Our products are certified organic, meeting all relevant Indian agricultural standards, and are free from harmful chemicals and pesticides.
2.3. Each product or service provided by our company will include specific details regarding its use, benefits, and any other relevant information, which will be outlined at the time of purchase or agreement.
2.4. We offer customized agribusiness solutions tailored to the specific needs of our clients, including farm planning, crop management, and sustainable farming practices.
2.5. All products and services are available for both individual farmers and commercial enterprises engaged in organic farming.
3. Pricing and Payments
3.1. Prices for all products and services are listed in Indian Rupees (INR) and include applicable taxes unless otherwise specified.
3.2. Payment for services or products must be made at the time of purchase or as agreed in the case of long-term contracts or services. Accepted methods of payment include bank transfer, credit or debit card, UPI, and other digital payment methods.
3.3. A deposit may be required for certain services, particularly for large-scale farming projects or long-term consultation services. The deposit amount will be specified in the agreement.
3.4. For recurring services such as farm maintenance or management, payments may be structured on a monthly, quarterly, or annual basis, depending on the agreement.
3.5. All payments must be received within the agreed time frame. Failure to make timely payments may result in suspension or termination of services.
4. Orders and Delivery
4.1. Orders for products can be placed via our website, by email, or directly through our sales representatives. All orders must be confirmed before shipment or delivery.
4.2. For products requiring delivery, we provide free delivery within specific areas of India. Delivery charges may apply for remote or distant locations, and the costs will be calculated at the time of order confirmation.
4.3. We are not responsible for any errors in the delivery address provided by the client. Clients are advised to verify their details before confirming an order.
4.4. Delivery times for products vary depending on availability and location. Clients will be informed of an estimated delivery date at the time of purchase.
4.5. For services, appointments and scheduling will be arranged based on availability, and a mutually agreed time will be confirmed in advance.
5. Returns and Refunds
5.1. We accept returns for any product that is unused, undamaged, and in its original packaging, within 7 days of delivery. Custom products or services that have been specifically tailored to the client’s needs are non-returnable.
5.2. For products returned due to defects or damage, we will either offer a full refund or a replacement, depending on the client’s preference and product availability.
5.3. Refunds will be processed within 10 business days from the receipt of returned goods. The original payment method will be used for refunds.
5.4. We do not accept returns for products or services that have been altered, used, or mishandled by the client.
6. Usage and Care of Products
6.1. Clients are responsible for ensuring that the products purchased, including organic seeds, fertilizers, and equipment, are used in accordance with the provided instructions and guidelines.
6.2. Any misuse or failure to follow the guidelines for product use may result in product failure, and we will not be held liable for such damages.
6.3. Organic farming practices require consistent care and attention. We provide instructions and consultations to ensure that all products are used effectively for optimal results.
6.4. For farm management services, clients must provide access to their land, equipment, and any other necessary resources for the successful completion of the service.
7. Service Maintenance and Support
7.1. We offer ongoing support and maintenance for clients who require assistance with organic farming techniques, tools, and equipment.
7.2. For any malfunction or issue with products or services, clients must notify us within 48 hours of delivery or service completion. We will assess the issue and offer a solution, which may include repair, replacement, or further consultation.
7.3. If our products are used in an inappropriate manner or for purposes outside their intended use, we are not responsible for any damage or loss that occurs.
7.4. Regular maintenance of farming equipment and tools is required for continued efficiency. Clients will be provided with recommendations on how to care for and maintain their products.
8. Intellectual Property and Confidentiality
8.1. All intellectual property, including trademarks, patents, designs, and copyrighted materials provided by us, remain the sole property of our company.
8.2. Clients agree not to copy, replicate, or distribute our proprietary materials without express written consent.
8.3. Any confidential information shared during the provision of services, including farming techniques, business strategies, or financial data, shall remain confidential and not be disclosed to any third party.
9. Liability
9.1. Our liability for any loss or damage incurred through the use of our products or services is limited to the amount paid for the product or service involved.
9.2. We are not responsible for indirect or consequential damages, including loss of crops, income, or reputation, arising from the use of our products or services.
9.3. We are not liable for any damages caused by third-party products or services that may be used in conjunction with ours.
10. Termination of Services
10.1. We reserve the right to terminate services if the client violates any terms of this agreement, including misuse of products, non-payment, or failure to cooperate with necessary procedures.
10.2. In case of termination, clients will be required to pay for any outstanding services or products delivered prior to the termination.
10.3. Clients may terminate services by providing written notice, but fees may apply for services already rendered or products delivered.
11. Force Majeure
11.1. We are not liable for any delay or failure to fulfill our obligations caused by circumstances beyond our control, including but not limited to natural disasters, political instability, labor strikes, or supply chain disruptions.
11.2. In the event of force majeure, we will make reasonable efforts to fulfill the agreement as soon as possible, but timelines may be adjusted based on the situation.
12. Governing Law
12.1. These Terms and Conditions are governed by the laws of India.
12.2. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in India.
